Terms of Service for Court Date

Welcome to Court Date, a platform operated by Slow Rodeo Holdings Co. ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and all related services, features, and content (collectively, the "Platform"). By accessing or using any part of the Platform, you agree to be bound by these Terms, our Privacy Policy, and our Terms of Sale. If you do not agree, you must not use the Platform.
1. Scope of Services
Court Date is a hybrid platform offering:
- An e-commerce experience for purchasing apparel and gear in the tennis, pickleball, and racket sports categories.
- A social platform enabling user profiles, Open Play matchmaking, messaging, and community events.
- A content/media channel (STRUNG) delivering tennis-related editorial, cultural, and lifestyle content.
You acknowledge that the Platform's services may evolve, and we may add, modify, or discontinue features at our discretion without prior notice or liability.
2. Eligibility
You must be at least 16 years old to use the Platform. If you are under 18, you represent that you have parental or guardian consent to use the Platform and agree to these Terms. By using the Platform, you represent and warrant that you meet these requirements, that your use complies with all applicable laws in your jurisdiction, and that you are not located in a country subject to U.S. or international sanctions or embargoes prohibiting use of the Platform.
3. Privacy Policy
Our Privacy Policy governs how we collect, use, store, and disclose your data. By using the Platform, you consent to our data handling practices as described therein. You are responsible for reviewing the Privacy Policy periodically for updates.
4. Account Registration
To access certain features, you must create an account using Privy, a third-party authentication service that uses one-time passcodes sent via email or other secure methods. You are responsible for:
- Providing accurate, current, and complete information during registration.
- Maintaining the confidentiality of your account credentials.
- All activities conducted under your account, whether authorized or not.
You must notify us immediately at hi@court-date.com if you suspect unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account. We may implement age verification processes to ensure compliance with eligibility requirements.
5. User Conduct & Community Standards
We strive to maintain a respectful, inclusive, and safe community. You agree not to:
- Harass, abuse, threaten, defame, impersonate, or exploit others.
- Promote or engage in violence, discrimination, or hateful conduct based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
- Upload, share, or distribute sexually explicit, offensive, defamatory, or unlawful content.
- Engage in spamming, phishing, or unsolicited promotion of products or services.
- Engage in fraudulent behavior, including but not limited to:
- Referral fraud (e.g., creating fake accounts or gaming incentives).
- Point farming or abuse of Platform systems.
- Deceptive behavior in Open Play matchmaking or other social features.
- Attempt to reverse-engineer, hack, or interfere with the Platform's functionality, security, or integrity.
- Use automated tools (e.g., bots, scrapers) to access or collect data from the Platform without our express written consent.
We reserve the right to monitor, moderate, suspend, or permanently terminate accounts or remove content at our sole discretion for any violation of these Terms or for any reason we deem necessary to protect the Platform or its users, without prior notice or liability. Violations may also result in reporting to law enforcement where required by applicable law.
6. Open Play, Messaging & Social Features
The Platform offers social features, including:
- Open Play for finding and connecting with others for casual or competitive games.
- Messaging to communicate with users you match with, follow, or interact with.
- Profile customization, event creation, and participation in community discussions.
By using these features, you acknowledge and agree that:
- Court Date does not verify the identity, background, or intentions of users, and any real-world interactions are at your sole risk.
- You are responsible for exercising caution and common sense when interacting with others, including meeting in safe, public locations for Open Play events and ensuring you have adequate personal health or liability insurance.
- We may monitor, review, or remove user activity or content that we deem unsafe, inappropriate, or in violation of these Terms.
- Misuse of these features, including sending harassing or inappropriate messages, may result in immediate account suspension or termination without notice or refund.
- We are not liable for any harm, loss, or damages arising from your interactions with other users, whether online or offline.
7. Purchases & Transactions
All purchases on the Platform are governed by our Terms of Sale, which include policies on shipping, returns, refunds, and payment terms. By completing a purchase, you agree to these policies. We reserve the right to refuse or cancel orders at our discretion, including for suspected fraud or violation of these Terms. If the Platform offers subscriptions or memberships, additional terms governing billing, cancellations, and renewals will apply and will be detailed in the Terms of Sale.
8. Intellectual Property
All content, trademarks, logos, designs, software, and other materials on the Platform (collectively, "Content") are owned by or licensed to Slow Rodeo Holdings Co. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works of any Content without our prior written consent, except for personal, non-commercial use as permitted by law.
If you believe any Content on the Platform infringes your copyright, you may submit a takedown request pursuant to our Digital Millennium Copyright Act (DMCA) policy by contacting hi@court-date.com.
9. Content Licensing & STRUNG
By submitting content to the Platform (e.g., comments, photos, videos, or other user-generated content), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display such content in connection with the Platform and our business, including for promotional purposes.
Content published under STRUNG is owned or licensed by Slow Rodeo Holdings Co. You may not copy, reproduce, or redistribute STRUNG content without our prior written permission.
You represent and warrant that any content you submit:
- Is your original work or you have the right to grant the above license.
- Does not infringe on the rights of any third party, including intellectual property or privacy rights.
- Complies with these Terms and all applicable laws.
We may remove or refuse to display any user-generated content at our sole discretion.
10. Third-Party Services
The Platform may integrate third-party services, APIs (including Privy for authentication), or links to external websites or applications. We are not responsible for the content, terms, privacy practices, or availability of these third-party services. Your use of such services is at your own risk and subject to their respective terms.
11. Termination
We may suspend, restrict, or terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms.
- Suspected fraudulent, abusive, or unlawful activity.
- Protection of the Platform's integrity, security, or user community.
Upon termination, your right to access the Platform ceases immediately, and we may delete your account and associated data, subject to our Privacy Policy. Sections of these Terms that by their nature should survive termination (e.g., Intellectual Property, Limitation of Liability, Indemnification) will remain in effect.
12. Modifications to the Platform or Terms
We may modify, update, or discontinue any part of the Platform at our sole discretion without notice or liability. We may also update these Terms at any time by posting the revised Terms on the Platform. The updated Terms take effect immediately upon posting. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.
13. Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Platform must be resolved through binding arbitration in Los Angeles County, California, under the Commercial Arbitration Rules of the American Arbitration Association. Arbitration will be conducted on an individual basis, and you waive any right to participate in a class action, class arbitration, or representative action.
Exceptions: You or we may seek injunctive relief in a court of competent jurisdiction for issues involving intellectual property or equitable relief. Any court proceedings will take place exclusively in Los Angeles County, California.
14. Limitation of Liability
To the fullest extent permitted by law, Slow Rodeo Holdings Co., its affiliates, officers, directors, employees, and agents will not be liable for:
- Any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to damages from user interactions, technical interruptions, data loss, or third-party conduct.
- Any harm, loss, or injury resulting from real-world interactions facilitated by the Platform, including Open Play events.
- Any amount exceeding the total fees paid by you to us in the 12 months prior to the event giving rise to the claim.
The Platform is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
15. Indemnification
You agree to indemnify, defend, and hold harmless Slow Rodeo Holdings Co., its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your violation of these Terms.
- Your use of the Platform, including any user-generated content you submit.
- Your interactions with other users, whether online or offline.
- Your violation of any third-party rights, including intellectual property or privacy rights.
16. Force Majeure
We are not liable for any failure to perform our obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, or technical failures.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. We may replace the invalid provision with one that reflects the original intent.
18. Entire Agreement
These Terms, along with the Privacy Policy and Terms of Sale, constitute the entire agreement between you and Slow Rodeo Holdings Co. regarding your use of the Platform, superseding any prior agreements or communications.
19. Accessibility
We are committed to making the Platform accessible to all users, including those with disabilities, in accordance with applicable accessibility standards (e.g., WCAG). If you encounter accessibility barriers, please contact us at hi@court-date.com.
